Terms of Service

The agreement for using Lenucs Console and lenucs.link: accounts, workspaces, your content, forms, product links, bookings and liability.

This agreement

These Terms of Service (“Terms”) are an agreement between you and Lenucs Pty Ltd (“Lenucs”, “we”, “us”) about using Lenucs Console and lenucs.link. By creating an account or using the service you agree to them. If you use the service for a business, you confirm you are authorised to bind that business, and “you” includes it.

These Terms include the Acceptable Use Policy, Billing and Payments, Refund and Cancellation Policy, AI Terms and, where we process personal information for you, the Data Processing Addendum. The Privacy Policy explains how we handle personal information.

Definitions

  • Lenucs Console or Console: our online software for leads, CRM, forms, bookings, tasks, campaigns, automations, analytics, product links and AI, operated by Lenucs Pty Ltd.
  • lenucs.link: the domain where Console runs and where Customers’ public forms and product pages are published.
  • Services: Console, lenucs.link and related features, support and documentation.
  • Customer: the person or business that creates a workspace and uses the Services for its own purposes.
  • User: anyone with a Console account, including members a Customer invites.
  • Workspace: a Customer’s separate area in Console, with its own members, data and plan.
  • Customer Data: information uploaded, entered or submitted by a Customer or its Users, or by people interacting with the Customer’s forms and pages.
  • Content: text, images, links, prices and other material a Customer publishes or stores, including on forms and product links.
  • Forms: forms a Customer builds and publishes to collect information.
  • Product Links: product or service pages a Customer publishes, with prices, images, buttons and links.
  • Bookings: appointments and services a Customer records or offers.
  • AI or Lenucs AI: AI-assisted features in Console.
  • Plan: the package of features and limits a Workspace is on (for example Free, Business, Pro or Enterprise). Subscription: a paid Plan billed for a period.
  • Third-party Services: services not provided by Lenucs, such as WhatsApp, payment providers or websites a Customer links to.

Accounts

  • You must be at least 18 and able to enter a binding contract.
  • Give accurate information and keep it up to date.
  • Keep your password secure and don’t share your account. You are responsible for activity under your account. Tell us promptly if you think it has been compromised.
  • One person per account. Invite colleagues as team members instead of sharing a login.

Workspaces, teams and roles

The person who creates a Workspace is its owner and acts for the Customer. Owners can invite members, give them roles (owner, admin, member and others shown in Console) and remove them. Each Workspace must always have at least one owner.

Owners and admins are responsible for who has access and what they can do. If there is a dispute about who controls a Workspace, we may ask for evidence of authority from the business and may restrict access until it is resolved.

Using the Services

You may use the Services only for lawful purposes and in line with these Terms and the Acceptable Use Policy. We give you a limited, non-exclusive, non-transferable right to use the Services during your Subscription or while on the Free Plan. We may change, add or remove features to improve the Services. If a change materially reduces a paid feature you rely on, we will tell you in advance where reasonably possible.

Your content and data

You keep ownership of your Content and Customer Data. Lenucs does not own your leads, customers, form responses or product information.

You give Lenucs a limited, worldwide, non-exclusive licence to host, store, process, transmit, display, back up and secure your Content and Customer Data, only as needed to provide, maintain, secure and improve the operation of the Services, and as the law requires. This licence ends when the data is deleted from the Services, apart from copies kept in backups or where we must keep records by law.

You are responsible for your Content and Customer Data: that you have the right to use it, that it is accurate and lawful, and that collecting it complies with the law. Use exports and backups for records you must keep.

Forms

When you publish a Form you are the responsible party for the information it collects. You are responsible for:

  • what you ask for and why, asking only for what you need;
  • telling respondents who you are and how you will use their information. Console lets you add a privacy notice and a link to your privacy policy on each Form;
  • having a lawful basis, and getting consent where the law requires it;
  • getting separate, optional consent before sending direct marketing. Submitting a Form is not marketing consent; use the optional marketing checkbox;
  • how long you keep responses, and answering respondents’ requests to access, correct or delete their information;
  • complying with POPIA, the Consumer Protection Act, the Electronic Communications and Transactions Act and any other laws that apply to you.

You must not use Forms to collect passwords, full payment card numbers or bank login details, government ID numbers, children’s information, or special personal information (such as health, biometric, religious, political, sex life, criminal or trade union information), unless the collection is lawful, you have any authorisation required, and Lenucs has agreed in writing to that use. File uploads must not be used to distribute malware or unlawful material.

Bookings

Console helps you manage appointments and services. You are responsible for your appointment details, availability, service descriptions, cancellations, no-show policies and communications with your clients. Unless we explicitly state otherwise, Lenucs is not responsible for the underlying service or appointment.

Lenucs AI

AI features are available on paid Plans, subject to a monthly usage allowance and the AI Terms. AI output can be wrong. Review it before relying on it. It is not legal, financial, medical or other professional advice.

Plans, fees and limits

Each Plan has the features and limits shown on our pricing page and in Console under Billing. If you reach a limit, the related feature may pause until the limit resets or you change Plan. Fees, renewals, cancellations and refunds are covered in Billing and Payments and the Refund and Cancellation Policy.

Online payments are not live yet

Paid Plans can’t currently be bought online. Until they can, any paid Plan is arranged with us directly and these Terms apply to it.

Third-party Services

The Services rely on, and can link to, Third-party Services, such as our hosting, database and AI providers (listed on the Subprocessors page), WhatsApp and social networks, and in future a payment provider. Third-party Services are governed by their own terms and privacy policies. We are not responsible for Third-party Services we do not control, but we choose our own providers carefully.

Availability and support

Console is an online service. We work to keep it available and reliable, but we do not promise it will be uninterrupted or error-free. Outages can happen because of maintenance, failures at our providers, attacks, or internet connectivity outside our control. We try to schedule maintenance for quiet times.

We do not offer a service level agreement (SLA) unless we agree one with you in writing. Support is provided through Help in Console and our contact form.

Suspension and termination

By you. You can stop using the Services at any time. Owners can request deletion of a Workspace from Settings, and anyone can request deletion of their account from Profile.

By us. We may suspend or restrict a Workspace, Form, Product Link or account, where reasonably necessary, if you seriously or repeatedly break these Terms or the Acceptable Use Policy, if there is a security risk or suspected fraud, if the law requires it, or if fees are unpaid after notice. Where it is safe and lawful we will tell you why and give you a chance to fix the problem. We may end these Terms for convenience with 30 days’ notice. If we do, we will refund prepaid fees for the unused period.

What happens next.

  • Access ends for the affected Users.
  • Before deletion, owners can export Workspace data (Settings → Export workspace data) and form responses (CSV).
  • When a deletion request is completed, we delete the Workspace or account data from the live service. Copies may remain in backups until they rotate out.
  • We keep records we must keep by law, or need for legal claims (such as billing records, acceptance records and audit logs), for the periods in the Privacy Policy.
  • If a Subscription expires or is cancelled, the Workspace moves to the Free Plan. Data above Free limits is kept but features may be paused.

Intellectual property

Lenucs owns the software, platform, design, branding, documentation and other materials that make up the Services. These Terms don’t transfer any of those rights to you. If you send us feedback or suggestions, we may use them without owing you anything. See Intellectual Property and Copyright, including how to report infringing content.

Limitation of liability

Nothing in these Terms limits or excludes any liability or right that cannot lawfully be limited or excluded, including your rights under the Consumer Protection Act, 2008 where it applies to you, or liability for gross negligence, fraud or intentional misconduct.

Subject to that:

  • The Services are provided on an “as is” and “as available” basis, apart from any express promises in these Terms.
  • Lenucs is not liable for indirect, special or consequential loss, or for loss of profits, revenue, business, goodwill or anticipated savings, however caused.
  • Lenucs is not liable for loss caused by your Content, your misuse of the Services, Third-party Services we do not control, internet or telecommunications failures, or events beyond our reasonable control.
  • For loss of data, our responsibility is limited to using reasonable efforts to restore the most recent backup available to us.
  • Our total liability for all claims arising out of or relating to the Services in any 12-month period is limited to the greater of the fees you paid us for the Services in that period and USD 100.

Indemnity

To the extent the law allows, you agree to indemnify Lenucs against claims, losses and reasonable costs (including legal fees) arising from: your Content or Customer Data; your products, services or sales; your Forms and how you collect and use personal information; your breach of law; or your breach of these Terms or the Acceptable Use Policy. We will tell you promptly about any such claim and let you take part in its defence.

Complaints, disputes and notices

Support and complaints. Contact us first through Help in Console or our contact form (choose “Support”). We will acknowledge complaints and try to resolve them within a reasonable time. If you are a consumer, you may also have the right to approach the National Consumer Commission or an accredited ombud.

Legal notices. Send legal notices to our contact form (choose “Legal”), or by hand or courier to our address for legal notices: York Road, Hill Crest, Mthatha, Eastern Cape, 5099. We send notices to the email address on your account.

Governing law. These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have jurisdiction, without depriving consumers of any right to bring proceedings where the law allows. We will try to settle disputes through good-faith discussion first.

Changes to these Terms

We may update these Terms. We change the version and dates at the top, keep earlier versions on file, and for material changes tell you in Console or by email before they take effect. If you keep using the Services after a material change takes effect you will be asked to accept the new version. If you don’t agree, you can stop using the Services and cancel any Subscription under the Refund and Cancellation Policy.

General

These Terms are the whole agreement between you and Lenucs about the Services, unless we sign a separate agreement. If a provision is unenforceable, the rest remains in effect. A delay in enforcing a right is not a waiver. You may not transfer these Terms without our consent. We may transfer them to a successor business. Questions: contact us.
